This is Meade's photograph of the doors handcuffed closed at the Wisconsin Capitol the night of the Senate's vote on collective bargaining.

Much as I disagree with them, the folks at Kos are not idiots. Besides this port, I recommends two steps:

1. Another email, just in case the first slipped by unnoticed, explaining that you won't go for a DMCA takedown immediately because you know sometimes mistakes happen. A DMCA takedown is sometimes necessary, but it's better if things can be settled person-to-person.

2. If you get no response in a day -- which is a long time in blog time -- then go DMCA.

If these rights matter to you, then politely but ruthlessly defend them.

Sorry, but you're being childish. The photo is on your blog - with a time stamp - so the idea you have to further "prove" it's yours is silly.

Your real issue is they want to re-appropriate it, and that, too, can be more effectively torpedoed by letting them do it.

Then, all you have to do is bust them with the evidence - the time stamped blog post with the picture and the text explaining it was the Left who put the handcuffs there - after they lie.

Nobody cares about your copyright because - again - nobody's stealing anything.

Not trying to snark it up: How can you tell the photo linked to on Kos was meade's, and not a similar photo taken from the same vantage point by someone else?

I am nice enough to put the Creative Commons license on all my (and Meade's) pics. People could at least follow that. If they don't, they deserve this attack.

I don't know. It's an inference based on several factors. I'm getting Meade to post a list of those factors.

If there's a statement out there of the police saying they handcuffed the doors of the Capitol, I'll believe it.

The doors have locks and the police have keys. They don't want the doors broken any more than would be done by the breaking of the locks. What would be their motivation to use handcuffs?

KOS likely did not reference Meade so as not to hide the source of picture that would contradict their statement that police put them on. Typical KOS lie.

It's funny how images work.

Last night, I turned on a TV already tuned to a Cinemax station. They were running one of those soft-core porn movies (no, I wasn't watching one when I shut the TV off before.)

As the picture came on, the scene was a close-up shot from behind a naked woman of her hands cuffed behind her back at butt level while she was busy blowing some dude.

Anyway, my first reaction: that reminds me of Meade's photo!

I know, "thanks for sharing."

And yeah, what BJM said too. Unless two people witht the exact same camera took the picture at the exact same time from the same spot in the same lighting and performed the exact same post- processing, AND somehow I screwed up my checksum comparison, then it is the same photo.

BTW - I've been doing my blog, in this manner, for five years. In all that time, I've had (I think) three requests to remove a photo.

That's how much of a issue this is out there.

Now, KOS playing politics with the truth - and not just playing with imagery as I do - that's a whole other thing. But it's also remedied as I told you:

Let them hang themselves.

Just did a quick check of some "Collectibles" sites. First glance (and guess), those cuffs were made by American Munitions in Fond du Lac, Wisconsin.

Per online scuttlebutt:

"1970, name changed to "American Handcuff Co." (due to fear of anti-war activists)"

And I've already thought of a good defense for them - I'm not going to say it here because, while not on this argument, I'm on your side - but, as I see it, you could lose.

Those look like Rothco cuffs, perhaps 10588. Perhaps you could ask around among the law enforcement people and find out if they are used commonly, or at all, by LEOs. Probably, they all use a couple different makes and models with the S&W being most common. Those aren't S&W cuffs.

Just more proof of the hypocrisy and thuggishness of the left. What's theirs is theirs and what's yours is theirs.

I suggest the building caretakers, and maybe the governor and legislators, get a good pair of bolt cutters. As you mentioned, this is a breach of the fire codes, which usually require that all doors in public building be able to be opened from the inside out.

Although the poster at DailyKOS removed the EXIF Metadata it is easy to ascertain that the photo is Althouse's.

1. Download Althouse's photo and the version posted at Kos.
2. Open them in Photoshop and resize and change the image resolution of Althouse's photo until it is the same dimensions and resolution as the version posted at Kos.

3. Stack both photos in a layered file, then change the Blend Mode to Difference and you'll see the pixels in each layer are identical.

It would be impossible for two photographers to capture the exact same image even if they were using the same equipment.

Just pulled downloads of both jpgs. Pulled into Photoshop and cropped to same scene. Enlarged Koss jpg to appropriate size. Matches to the pixel, aside from dithering issues with size changing.

Not likely at all that someone was in the identical angle and had a flash in the exact same position.

Regardless of who did the handcuffs, it's a very bad idea to chain doors closed that might be needed in the event of fire.

I'd like to think that the Wisconsin police were better trained than that.
