Revolt of the Politically Incorrect

Mick said...

Cruz was naturalized by 8 US Code 1401(g) and not eligible. The State Dept. also doubts his eligibility in 7 FAM 1131.6-2(a):a. "It has never been determined definitively by a court whether a person who acquired U.S. citizenship by birth abroad to U.S. citizens is a natural-born citizen within the meaning of Article II of the Constitution and, therefore eligible for the Presidency".

Not only do they say he may not be eligible, they say that determination is judicial, not political. All the argument now public about this issue make it ripe for adjudication.

Filed and served in Ft. Lauderdale (# CACE15022044). Defendants gave until 1/8/16 to respond.

This is a "law blog", correct?

Watched a documentary on PBS tonight - Chuck Norris versus Communism. How smuggling video tapes of western movies into Romania helped topple the regime of Nicolae Ceaușescu and his lovely bride Elena.

If you're a freedom loving patriot, I would highly recommend it.

'Interesting' Brief filed in the upcoming Texas abortion regs SCOTUS case:
"Amici’s [113 of them] experiences demonstrate the real world effects of abortion access on the lives and careers of women attorneys, and underscore the truth of the Court’s observation in Casey that reproductive choice facilitates women’s ability “to participate in the economic and social life of the Nation.” 505 U.S. at 856."

Mick, do you seriously think that a person born to a US citizen is not a citizen themselves? Here's a hypothetical for you to chew over: if a fertilized egg of 2 citizens is carried out of the country and implanted in a foreign surrogate, is it a citizen when born? Come into the 21st century Mick.

Mick:

Given your *opinion* that means John McCain, Barry Goldwater and George Romney were not eligible to be president.

You are dead wrong. And go find a federal judge who will agree with you. Not going to happen.

This Harvard L. Rev. article settles the question.

Trump in full WWE mode on this. Ted is "The Mad Canadian."

Donald is the rich and smart businessman who will build a wall and hire Top Men to fix things. He also loves you and is not a meany like Mr. Potter.

Run every thing Trump says through the WWE filter and it works.

I loved TV rasslin when I was 10. Then I grew up.

Another hypothetical Mick:

A US citizen impregnates a foreign national (a New Zealander). On a Quantas flight from Australia to the US, the foreign national goes into labor while crossing international date line. While over Mexican airspace, the baby's head exits the birth canal and then is fully delivered on the taxi-way in Houston.

The question is: For which Olympic bobsled team is the youngster eligible to compete?

A) Kenya
B) Panama
C) The Arizona Territory
D) Mexico
E) Canada

GAB Sent Their Attack Dog After Me - One of Their Biggest Critics

Guy found out what online records of his were seized from his employer in the John Doe probe. (Wisconsin). Took everything, besides 4 years of emails, his and his daughters medical records, copies of his tax returns - whatever he had in Cloud storage. He thought the Milwaukee Journal Sentinal reporter was trolling him when he asked if a search warrant was executed at his home.

@Jack Wayne & David Begley: What you guys miss is the very real possibility of a dual national becoming POTUS. A POTUS with fealty to two different nations. Cruz is not an example of this, but there's no reason he couldn't be had he not renounced his Canadian citizenship. The US Constitution pertaining to POTUS eligibility does not yet know how to deal with dual citizenship but that day is fast approaching. Or maybe I'm reading you both wrong and you're the types who believe multiple passports and conflicted loyalties are "cool."

What are the qualities of women attorneys that make adoption less efficient than abortion, other than vulnerability to oxytocin?

What would happen to the legal profession if it looked more like the health care industry, i.e., extended office hours and Medicare/Medicaid reimbursement?

And does the fact that at least (or greater than) 50 percent of the employers who hire nannies, especially live-in ones, are professional women help to explain the 77 cent phenomenon: http://www.nannynetwork.com/library/Parentlib/flsa.cfm.

Scott Bollig's (sp) charges should be amended to assisted miscarriage and practicing medicine without a license. Any other charges would be sexist. An unwanted child is unwanted, regardless of the sex of the parent.

I am thinking I should go down to the Trump rally in Burlington today. Should provide a lot of humor from the national socialists, I mean the Sanders fans. No indication that the locals understand they are being set up as props.

Ted Cruz does not have any loyalty to Canada. He does not like hockey.

Trump, on the other hand, has a problem. His only loyalty is to Trump.

Other down side to a Trump presidency: Imagine how the current Mrs. Trump will redocrate the White House.

The hypotheticals above are fun! Similarly:

We all understand that "American soil" doesn't mean the mother doesn't actually have to be lying on dirt when in labor. She can be on a bed. She might be several floors up in a hospital. What if she were on the International Space Station? Would the baby be American only if the ISS happened to be directly above the USA? Does the "International" part disqualify the baby? What if the birth is on an American spacecraft? or on the moon, right near the American flag they planted up there? How about Puerto Rico? or inside the American embassy in France? or right on real dirt, imported from America and layered on a patch of ground in Cancun?

I used to wonder if women were still second class citizens, but this seems to be proof. Posting a rant online is equal to fingering a German woman according to this genius.

German BeuroRalf Jaeger, interior minister for North Rhine-Westphalia, warned that anti-immigrant groups were trying to use the Cologne attacks to stir up hatred against refugees.
"What happens on the right-wing platforms and in chat rooms is at least as awful as the acts of those assaulting the women," he said. "This is poisoning the climate of our society."

chickelit said...

@Begley: Let me put to to you differently: Had Cruz been born in Kenya instead of Canada with a Kenyan father instead of a Cuba one, would you care?

I didn't think so.

So why all the fuss about a Hawaiian birth certificate? What did it prove?

If jus sanguinis is so important to you, what about the case of child born in America to foreign parents? Then the whole question shifts to jus soli.

Why even bother with these nuances when we don't have to do.

Trump, on the other hand, has a problem. His only loyalty is to Trump

Whereas Hillary's loyalties are straight up for sale to the highest bidder, as they should be in America!

The freedom loving true Americans here in Vermont are of course demanding that Trump not be allowed to speak.
